Classification Of Law And Law - 912 Words

Classifications of Law Everything that a person does is governed by a set of rules that are followed. There are rules for sports, the workplace, and games. There are also rules imposed by morality and custom that play an important role in telling people what is right and what is wrong. However, some rules impose are called laws. In this paper analysis, the classifications of laws will be discussed and how it relates to the biblical concept of justice. The classifications of laws include: public versus private law, criminal versus civil law, substantive versus procedural law, common versus statutory law, and law versus equity. Laws are rules, that are made by the state or courts, that are designed to control or alter a person’s behavior. Unlike rules of morality, laws are enforced by the courts; if a law is broken, the person who broke the law may have to pay a fine, pay damages, or go to prison. If people did not live in a structured society with others, laws probably would no t be necessary. People would just do as they please, with no regards to anyone’s feelings. But ever since individuals began to associate with people, laws have been implemented to keep personal property and people lives safe. Human Papillomavirus (HPV) is a highly contagious sexually transmitted disease that is believed to be the precursor of several cancers, especially cervical cancer. Scientists have developed two vaccines believed to prevent several strains of the virus. Much controversy has surrounded the birth of these vaccines because law makers want to make the vaccine mandatory for school-aged children. The public is outraged and therefore the controversy regarding the use of the vaccine is growing. However, there are many studies showing that the vaccine is safe to use and that it has been effective in lowering the rate of cervical cancer. Health care providers may be of help in healing the spirit of the patient but cannot directly provide the service and the process. The vision statement on the other hand does not support this purpose of the organization evident by its emphasis on compassionate and excellent service – skills which can be learned and developed by most health care professionals through proper professional training and schooling. The vision statement anchored its commitment on the core competencies and professional capabilities of the people in the organization. On the aspect of the similarities of the mission and vision statements, both echoed a commitment to serve the community. Both echoed a quality of healthcare service that is anchored on commitment and cooperation. The mission and vision statement also reflected the unity of the people in the organization to serve the community and its patients. Also, both the mission and vision statement further showed the failure to recognize the contribution and importance of the people in the organization in relation to the attainment of the mission and vision of the company. The organizational mission statement is just merely descriptive of what the community can expect from the health care service of the organization, thus it does not function to inspire or guide the people in the organization. The vision statement too does not reflect something that would inspire and make people look forward to their future in the organization. Both failed to really articulate a statement according to its intended purpose. 2. The mission and vision statement has influenced my practice as a nurse as it raised my awareness of the goal of the organization to deliver compassionate and excellent health care service to help improve the health of the community. The mission statement made me realized that our responsibility of healing is not just on the physical aspect of the patient but including the mental and spiritual aspects of the patient in order that we can help improve our community’s health. Guided by these goals, I was able to view responsibilities to my patient beyond their physical aspect, however, it also made me concerned if I could be of help in restoring the soundness of the spirit of the person. I may have all the professional training and knowledge in my job but this does not guarantee that if applied it can also help heal the spirit of the patient. This goal put me into quandary on the ethical considerations if faced with a situation where my own personal beliefs might interfere in the healing process of the spirit of the person. The process of helping heal the spirit of the patient might make me subjective rather than objective in my job.   Also, as an employee both the mission and vision statement negatively impacted on my view of my future in the organization because both do not reflect organizational aspirations for the people which I considered very important.. I am aware of my responsibility to the community and to the organization I am serving, but the organization should also be aware of the needs and aspirations of the people who will make the organization mission and vision possible. The content of the mission and vision statements of the organization must inspire and guide people. 3. Our organization’s vision (philosophy) statement falls short on some important aspect of its function. Accordingly, the vision of the organization refers to the category of intentions that are broad, all-intrusive and forward-thinking. The organizational vision statement describes aspirations for the future, without specifying the means that will be used to achieve those desired ends. Our organization’s vision does not clearly reflect and define the future to stimulate. Our organizational vision defined the character and identity of the people in the organization however, the way the organizational vision is stated does not reflect on what the organization aspires to become, to achieve, to create – something that will require significant change that will challenge people to attain progress and professional advancement. It does not provide encouragement to grow with the organization. The organizational vision only state the present being and identity but it does not so much reflect where it is going to be in the next years to come. A dynamic organization should reflect aspirations to improve and change according to the demands of the ever-changing environment. Above all, the organizational vision should also be consistent with the organizational mission as the latter dictates the courses of action in the organization while the former identifies the strategies to take to attain the organization’s purpose (mission). 4.   My suggestion is to state the mission and vision statement in a manner consistent with each other and should reflect on the core competencies of the organization and the people in the organization. On this manner the people in the organization will be able to really deliver a quality of service that shows highest degree of professionalism, compassion, and excellence. The organization can also strengthen its competitive edge by capitalizing on the professional skills and competencies of its people. Through this approach a brand of service that is second to none in professionalism, integrity, dignity and excellence will be achieved and people are likewise provided the opportunity to apply their skills and fullest potential to the organization and the community. Child Observation Report Essay For this project, I observed my mothers preschool class for three hours, and three kids that she baby-sits on weekends for three hours. Most of the kids that are in the preschool class were three years old, but there was one five year old. The kids I helped baby-sit were two twin three year old girls, and one five year old. When I first arrived at the preschool, the kids seemed very shy towards me and they did not seem like they were very sociable. I was a stranger to them, and I would have to guess that all of the children were experiencing a little bit of stranger anxiety. The boys in the group were very wild and rambunctious, and the girls seemed to be shy and reserved. This would agree with what we have learned in class that boys will tend to be more outgoing, and girls will be more reserved. In preschool class, my mother has various stuffed animals, and I also noticed that the children that I helped baby-sit had a lot of stuffed animals. My mother often has puppet shows and the kids love it. I noticed one child was sitting at the table having a conversation with a stuffed beaver. The two twin girls I was baby-sitting had a giant stuffed bee, and I would chase after them with it and sting them. This shows what the book calls animistic thinking. According to the book, this kind of thinking is the belief that inanimate objects are alive. Another form of animistic thinking would be when my mother told a story about a leprechaun. When my mother asked where leprechauns lived, one child replied that, and I quote, leprechauns live in the grass and run around from tree to tree, they are itsy bitsy and very hard to see. These children believed that these creatures were real, but they just could not see them. But, the fun with the leprechauns had just begun. To test the childrens belief in the unrealistic, I had my mother and the kids make little pots, and then I had my mother tell all of the kids that if they were good, the leprechaun would leave them gold in their pot. While these kids were eating their snacks, I left and put gold candy in their pots, and then waited for their reactions and comments when they came back to see what had happened. I wish I could have recorded their reactions because some of them were hilarious. I noticed that one child jumped around and screamed that he was here, he was here, and another child was looking around the room trying to find the leprechaun. Overall, I found that my animistic thinking project worked well. To conclude my observations on animistic thinking, I found that most of the kids seemed to have beliefs based on what they sensed to be true, rather than on what would be logic or rational. Language development between the three-year-old kids, and the five-year-old kids was amazing. There were some grammatical morpheme problems that I picked up on throughout my stay at the preschool and when I was baby-sitting the other girls. I did not notice many mistakes by the five-year-old girl, in fact she was very good with sentence structure and words. But, I did notice a lot of the three year old kids struggled with prepositions, suffixes, and prefixes. I few sentences I heard were, he sitted down on me, or she hitted me with the beaver. As you can see, the children are learning that they need to add the ed to the end of some words, but they do not know when it is and when it is not appropriate to do it yet. Are People Obedient Essays - Social Psychology, Conformity Are People Obedient ARE PEOPLE OBEDIENT? By Queron Thompson Does everyone in society go against what they believe in merely to satisfy an authority figure? Stanley Milgrams Perils Of Obedience expresses that most of society supports the authority figure regardless of their own personal ideals. Milgram says to the reader, For many people, obedience is a deeply ingrained behavioral tendency, indeed a potent impulse overriding training in ethics, sympathy, and moral conduct (Milgram 606). Is Milgrams statement telling us obedience is an unparalleled force in todays society? Two authors, George Orwell and Langston Hughes, provide us with incidents that support Milgrams findings. George Orwells work, Shooting an Elephant, can be used as an example of Milgrams discoveries. He recalls an account of himself as a British policeman called upon to take action against a belligerent elephant rampaging through a small Burmese Village. Orwell makes it a point to show that the natives of the village, who at any other time would have looked upon the him in disfavor, are now backing him in hopes of the animals destruction. Orwell realizes it is quite unnecessary to kill the animal, yet does it anyway. Why might you ask? Milgrims findings on peoples obedience to authority can be seen as an answer to this question. In the reading Orwell says, And suddenly I realized that I should have to shoot the elephant after all. The people expected it of me and I had got to do it: I could feel their two thousand wills pressing me forward, irresistibly.(Orwell 771). With this statement, we can easily determine the role the villagers take on. Suddenly, they have taken on the role of the authority figure and Orwell the conforming citizen. In Milgrams Perils Of Obedience, the test subjects or teachers follow the experimenters authority and inflict punishment upon the actors or learners without any regard to their own feelings. In Orwells writings, he has also put the natives or authority ahead of his own personal convictions and has proven Milgram an astute judge of human character. Langston Hughes, author of Salvation offers us a different perspective on Milgrams findings, obedience before morality. Mr. Hughes paints a picture of himself as a little boy, whose decisions at a church revival, directly reflect mans own instinctive behavioral tendencies for obedience. A young Langston, whos congregation wants him to go up and get saved, gives into obedience and ventures to the altar as if he has seen the light of the Holy Spirit. Can he really see it or is this just a decision to give into the congregation, or what we consider the authority? Milgrams deeply ingrained human impulses are evident at this point. Hughes goes on to say, So I decided that maybe to save further trouble, Id better lie, too, and say that Jesus had come, and get up and be saved; So I did (Hughes 32). In saying this, Young Langston has obviously overlooked his personal belief of a visual Holy Spirit to meet the level of obedience laid out by the congregation. Once again, Stanley Milgrams theor ies are correct. His discoveries bind us to the fact that people may believe strongly in an idea or thought but, will overlook that belief to be obedient. In conclusion, what does this leave the reader to think? Do people conform to authority? Is society holding back its views inorder to meet a level of obedience? Stanley Milgram has pointed out a human characteristic that may very well be in each and every one of us. George Orwell and Langston Hughes have both given us two examples that support and defend this theory. With all this evidence compounded, we the reader can make a justified assumption that everyone in society has, at one time or another, overlooked his or her personal feelings to conform. This occurrence, whether it is instinctive or judgmental is one that each individual deals with a personal level.

Qualitative Safety Research at MG Resins Casey Bird   Abstract In this article, qualitative safety research at MG Resins will be discussed. MG Resins is a polymer production plant that is projected to be the largest producer of plastics in the United States. Currently, this company is under construction and has experienced numerous incidents and delays. To overcome these complications, MG Resins will utilize the importance of qualitative research to enhance the construction project and prevent future incidents. The type of qualitative research that is being implemented is safety knowledge management (KM), and safety climate and behaviour research. These qualitative research tools are required to enhance the organizations safety program.   Qualitative research provides the ability to understand other employees safety needs or perceptions. It allows an organization to become a safety-first climate. In order to achieve a safety-first climate the organization needs to learn areas of needed enhancements. This is why qualitative safety research is paramount at MG Resins. MG will discuss the tools utilized for qualitative research, and how the effectiveness is measured in that research. To measure qualitative effectiveness the key safety indictors that will be utilized at MG is the Experience Modification Rate (EMR), hazard observations with Stop Work Authority (SWA), and employee involvement. This paper will also inform the reader on the importance of safety research, safety methods and safety methodology behind a safety-first climate. Qualitative Research in Safety MG Resins is a polymer production plant that is projected to be the largest producer of plastics in the United States. Currently, this company is under construction and has experienced numerous incidents, work delays, and cost overruns. During the construction process there has been an extensive amount of recordable injuries and incidents. Overall, MG Resins has an Experience Modification Rate (EMR) of greater than 2.0. The EMR is a number that utilizes payroll, and total incident loss experiences to measure insurance cost premiums (Smith, 2009). According to Smith (2009), a good EMR of less than 1.0 is achievable; only if the company adopts excellent incident control and prevention practices.   MG Resins EMR reflects a lack in excellent incident control and prevention practices. At MG, a majority of the incidents are not getting reported to MG management. To overcome this issue, qualitative research is now used to understand and evaluate the current safety program. Qualitative research relies on researching the individuals thoughts, perceptions, and experiences about a safety program (Olsen, Bjerkan, Naevestad, 2009). It is imperative to incorporate qualitative research to ensure a proactive and successful safety program. To be more proactive towards accident prevention, MG set high standards for a safety-first climate. A safety-first climate is defined as one that exhibits employees beliefs in regards to safety. Research indicates that these beliefs are directly related to safety behaviors and incidents (Huang, Jeffries, Tolbert, Dainoff, 2017). In support of these beliefs, there is an expectation for employers to research and implement safety programs. According to Neal and Griffin (2002), only just recently have organizations focused on implementing proactive safety behaviors.   This is mainly due to the extensive amount o f direct and indirect cost associated with workplace incidents.   Thus, MG Resins adopted safety knowledge management (KM) as primary qualitative research to counteract the incident rate. Effective KM is seen when organizations continuously improve production, quality, safety, and corporate image. The only way to ensure this is achieved is to acquire employee feedback and involvement. MG utilizes feedback surveys after every training session to ensure the correct goals and/or messages have been received. These surveys also provide other data to the presenter and management with an outsiders view as to enhance the programs. Safety Climate and Behaviour research model is utilized as secondary qualitative research to support MGs primary KM research. To measure the overall effectiveness of the KM research, MG Resins utilizes the Safety Climate and Behaviour research model. This research model is developed by Andrew Neal Mark Griffin (2002). These authors developed a model based on a five year study to convey the importance of a safety-first climate (Neal Griffin, 2002). The components utilized to link the relationship of a safety-first climate in the workplace are leadership support, safety knowledge, and safety motivation to measure the overall safety performance. This model utilizes two data points to research an organizations safety performance. The first data point utilizes upper management and leadership as antecedents. Antecedents are individuals that indirectly affect the behavior of the entire organization in regards to knowledge, skill, or motivation (Neal Griffin, 2002). Antecedents are normal ly considered as upper management. These antecedent individuals are normally the organizations Company Executive Officers (CEOs), or Directors. According to Neal and Griffin (2002), the second data point utilizes determinants as a performance measure of factors that directly affect worker behavior through their actions. These determinant individuals are normally the organizations middle management. This is usually the front-line employees immediate Supervisor, or Manager. The determinants directly affect the workers performance in regards to knowledge, skills, and motivation (Neal Griffin, 2002). In other words, people are dependent upon management to be role models through their daily actions. For this reason, MG developed a Fundamentals of Management (FOM) training program that is currently being implemented. This FOM training ensures management takes proper actions at all times. The FOM presentation identifies various research methods that visualize incident trends by using the safety triangle. According to the American Society of Safety Engineers (ASSE), the safety triangle was created 86 years ago by H. W. Heinrich (ASSE, 2014).   The safety triangle provides an incident ratio that reassures the root causes of all incidents are identified. It is imperative that even minor incidents are prevented, which in turn will prevent the major incidents (ASSE, 2014). With the safety triangle, MG inputs their incident ratio into the safety triangle to identify problem areas and trends. The FOM presentation also utilizes research based on the total number of SWAs employees utilized and resolved. Employees are trained, supported, and motivated to utilize SWA for any hazard observations. A hazard could be any unsafe act or condition in the work environment. This continuous employee involvement is critical to ensure the safety program is psychologically working.   As cited in Neal and Griffin (2002), psychological climate is when individual perceptions of the work environment are established. It is when these perceptions of the work environment are shared, that it becomes an organizational climate (as cited in Neal Griffin, 2002). It is important for management to receive feedback from employees on needed enhancement areas. During the FOM presentation, leaders are encouraged to support, train, and motivate employees to be safe on any job (as cited in Neal Griffin, 2002). To overcome any miscommunication, it is critical for a safety program to test employees on knowledge learned. As a follow-up, MG Resins constantly researches employees feedback by issuing questionnaires on safety-related objectives. This research provides another means to ensure employees have received the correct message, as well as enhance future safety objectives. This helps to ensure the principles of learning have been achieved. Safety compliance and participation can only be achieved once employees have the proper knowledge, skills, and motivation (Neal Griffin, 2002). Safety compliance and participation is measured by MG Resins to ensure proper relationship behaviors are occurring. When safety compliance and participation are both lacking in the workplace, the root cause can be traced back to the determinants of performance. If individuals do not have knowledge, skill, or motivation they will not comply or participate (Neal Griffin, 2002). As a result, MGs management is encouraged to follow the proper relationship among antecedents, determinants, and components for sufficient safety performance. Research is utilized on a daily basis within MG Resins to determine the overall success and failures. Research is paramount in the safety field to prevent future incidents. Qualitative Research Results Since implementation of the qualitative research, MG safety program has improved significantly. Currently, MG has an EMR of 1.5, and more employees are becoming involved to enhance the safety program. More incidents are now being reported, as well as SWAs. Last month alone there was a total of 30 SWAs that was reported to management. Management has also resolved hazard observations immediately to show employees the importance of their help. MG has also formed a safety committee comprised of ten employees that freely volunteered to be on the committee. A safety committee is the sole driving force behind the success of a safety program. It provides a direct voice for employees out in the field to upper management on needed enhancements. Conclusion In my opinion, as a safety professional, qualitative research is a required necessity to improve any organization. Without qualitative research an organization would become stagnant in day-to-day operations and programs. Qualitative research allows constructive feedback from employees to the organization which ensures proactive actions. Proactive actions are vital in a safety program and an organization as well. As a result, a future qualitative tool at MG Resins will consist of a technology implementation called Eagle Eye. This is a software program, as well as a phone application. Eagle will allow employees to input hazard observations, needed enhancements, and other organization comments. This new technology will allow a quicker and effective means to track data. It will allow real time safety needs directly to management and supervisors. This ability will provide an effective means to reduce and prevent incidents. In hindsight, when an organization is able to be proactive in reducing or eliminating incidents, it can then focus on other areas of the organization. These areas are production, quality, safety, and corporate image. Qualitative research will propel, achieve, and advance desired goals in these departments. As a result, the organization is able to understand the employees needs and wants. This in turn creates sustainability and enhancement of in an organization. One of the best examples of an entrepreneur succeeding in their idea for success lies in one man: Sam Walton, creator of Wal-Mart. At the heart of Wal-Mart's growth is the unique culture that "Mr. Sam" built. His business philosophy was based on the simple idea of making the customer No. 1. He believed that by serving the customer's needs first, his business would also serve its associates, shareholders, communities and other stakeholders. The goal at Walmart.com is to bring Mr. Sam's culture and philosophy from Wal-Mart stores to the Internet. Sam Walton had three basic beliefs the company was built on. Sam Walton built Wal-Mart on the revolutionary philosophies of excellence in the workplace, customer service and always having the lowest prices. They have always stayed true to the Three Basic Beliefs Mr. Sam established in 1962: 1. Respect for the Individual 2. Service to Our Customers 3. Strive for Excellence Sam Walton always knew he wanted to be in the retailing business. He started his career by running a Ben Frankling franchise store and learned about buying, pricing and passing good deals on to customers. He credits a manufacturer's agent from New York, Harry Weiner, with his first real lesson about pricing: "Harry was selling ladies' panties for $2 a dozen. We'd been buying similar panties from Ben Franklin for $2.50 a dozen and selling them at three pair for $1. Well, at Harry's price of $2, we could put them out at four for $1 and make a great promotion for our store. Here's the simple lesson we learned ... say I bought an item for 80 cents. I found that by pricing it at $1.00, I could sell three times more of it than by pricing it at $1.20. I might make only half the profit per item, but because I was selling three times as many, the overall profit was much greater. Simple enough.
